Why Attribution Matters: A Legal Perspective
This is a new episode of Nisos’ ongoing panel series on critical issues at the nexus of law and (cyber)security. During this webinar, our panel of experts will discuss the legal ramifications of cyber attribution. When a security incident occurs, legal counsel and the security team must consider many factors in determining how far to take the investigation and whether it is necessary to identify the perpetrators of the crime. The private sector is under siege by threat actors of nation-state caliber (and often, affiliation); thus efforts to stop and identify these actors as they attack enterprise organizations is a critical step toward disrupting their behavior. Most experts in the field will agree that attribution at the nation state and actor organization level is difficult but necessary to build proper defenses. In this session we will discuss when it is appropriate and necessary to attribute and unmask the specific individual threat actor’s identity and how organizations can and should use this information to gain context, utilize the information in the legal process, and prevent future incidents.
